Welcome to the DUER Membership Program (the “Program”). By enrolling or participating in the Program, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully. If you do not agree to these Terms, you may not participate in the Program.

 

1. Eligibility 

The Program is open to individuals who are the age of majority in their state, region, or country of residence and who provide and maintain a valid email address. Corporations, associations, or other groups may not participate. DUER reserves the right to limit or refuse membership at our sole discretion. 

 

2. Membership Enrolment 

You may enrol in the Program through our website by creating an account and agreeing to these Terms. No purchase is required to join. Membership is not automatic—existing account holders must actively enrol to participate.

There is a 30-day grace period for users to enrol post-purchase and claim the spend from orders within 30 days from their enrolment date.

Each member may only maintain one Program account associated with a single email address. Account sharing, selling, or transferring is strictly prohibited.

You are responsible for maintaining accurate and up-to-date information in your Program account. You can update your information via the DUER website.

In the event of a dispute regarding membership, the authorized account holder of the email address used at enrolment will be deemed the member. 

 

3. Tier Structure & Qualification 

The Program includes three (3) tiers based on qualifying spend during a rolling 12-month period that is subject to change.

Qualifying Annual Spend is defined as the net amount spent on eligible purchases made while signed into your DUER account, after applying any discounts and before taxes, shipping, returns, or adjustments. Eligible purchases must be made in DUER-owned retail locations or on shopduer.com. Purchases made through third-party retailers, wholesalers, or unauthorized sellers are not eligible.

Grandfathered Entry: Members who enroll within 90 days of Program launch may be assigned a tier based on lifetime spend. This grace period expires after 90 days, on October 14th 2025.

Tier Maintenance: You must meet or exceed your tier’s annual spend threshold within 12 months of entering that tier to maintain your status. Otherwise, you will be moved to the appropriate tier.

30-Day Hold: Purchases are subject to a 30-day hold before being counted toward tier qualification to account for potential returns.

30-Day Grace Period: There is a 30-day grace period for users to enrol post-purchase and claim the spend from orders within 30 days from their enrolment date.

Modifications: DUER may modify tier thresholds or tier benefits at any time with reasonable notice.

  

4. Member Benefits 

Benefits vary by tier and may include: 

  • Exclusive discounts and promotional offers 

  • Early access to select product launches and seasonal sales 

  • Invitations to DUER member-only events and experiences 

  • Birthday rewards (with eligible profile completion) 

All benefits are subject to availability and change, and may have specific terms or conditions for redemption. They are non-transferable, cannot be redeemed for cash, and may not be combined with other offers unless explicitly stated.

Retroactive application of benefits to past purchases is not allowed unless otherwise stated. DUER is not responsible for lost or expired benefits.

5. Exclusions and Non-Qualifying Purchases 

The following types of transactions are not eligible for tier calculation or benefit redemption: 

  • Purchases from third-party retailers or unauthorized sellers 

  • Gift card purchases or redemptions 

  • Sales tax, shipping, and handling charges 

  • Refunded, returned, or canceled purchases 

DUER reserves the right to update this list of exclusions at any time. 

 

6. Communications 

By enrolling, you agree to receive Program-related communications, including transactional updates and promotional emails. You may unsubscribe from marketing communications at any time, but DUER may still send essential Program updates such as account changes, tier updates, or service modifications. 

 

7. Account Management 

To ensure purchases count toward tier status and benefits, you must be signed into your DUER account when making purchases. DUER is not responsible for tracking purchases made under guest checkout or with incorrect account details.

Members can view and update their information or cancel their membership through their online DUER account. 

 

8. Program Abuse and Account Termination 

DUER may monitor Program activity for abuse. Any suspected misuse—including, but not limited to, manipulating spend thresholds, fraudulent transactions, reselling, or unauthorized account sharing—may result in membership suspension or termination without notice. In such cases, all accrued benefits may be forfeited.

DUER reserves the right to refuse or cancel membership at any time and for any reason.

 

9. Modifications and Termination 

DUER may, at any time and without prior notice: 

  • Modify, suspend, or terminate the Program in whole or in part 

  • Change tier thresholds, benefit structures, or eligibility rules 

  • Limit, revoke, or cancel any membership or associated benefits 

Continued participation following any modifications constitutes acceptance of the updated Terms. 

 

10. Privacy 

Your participation in the Program is subject to the DUER Privacy Policy, which outlines how your personal information is collected, used, and protected. By joining the Program, you consent to DUER’s data practices. 

 

11. Limitation of Liability 

DUER makes no representations or warranties of any kind regarding the Program, either express or implied. Participation is at your own risk.

To the maximum extent permitted by law, DUER shall not be liable for any direct, indirect, incidental, or consequential damages arising from or related to the Program, including lost or unredeemed rewards. 


12. Governing Law and Dispute Resolution 

These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada, without regard to conflict of law principles.

Any disputes arising under or in connection with these Terms will be resolved exclusively through binding arbitration or in small claims court, where permitted. By joining the Program, you waive any rights to class action lawsuits or jury trials. 


13. Changes to Terms 

DUER may update these Terms at any time. The revised Terms will be posted on shopduer.com with an updated effective date. Your continued participation in the Program after such changes signifies acceptance of the new Terms. It is your responsibility to review these Terms periodically.
